HC recalls relief given to Varadarajan citing ‘suppression’ of facts

New Delhi : The Delhi high court on Thursday recalled its earlier order setting aside the Centre’s refusal to grant an Overseas Citizen of India (OCI) card to the Wire’s founding editor Siddharth Varadarajan, taking exception to his alleged suppression of the fact that another court had barred him from travelling abroad without prior permission.
On May 12, the high court had set aside the Centre’s April 2 order rejecting Varadarajan’s application for conversion of his Person of Indian Origin (PIO) card to OCI card, observing that no reasons were provided for the rejection.
But on Thursday, the Centre’s lawyer, additional solicitor general Chetan Sharma, along with standing counsels Ashish Dixit and Nishant Gautam, drew the court’s attention to the fact that the Allahabad High Court on May 15, 2020, had barred Varadarajan from travelling outside the country without the trial court’s permission.
Justice Purushaindra Kumar Kaurav observed that, prima facie, Varadarajan was guilty of suppressing a material fact from the court and termed the conduct “serious”.
The court directed him to file an affidavit explaining his conduct in seven days and said it would consider, based on the affidavit, whether any action ought to be initiated against him
“This is very serious. We have to dismiss your writ petition only on this ground. Because of suppression….. the petitioner does not require any leave to be given by the Constitutional court. Because of suppression. We always believe that the petitioner is approaching the court with full disclosure,” the court said.
